What Misconceptions Do People Have About Personal Injury Attorneys?
The biggest misconception people have is that personal injury attorneys are greedy “ambulance chasers” who represent clients with frivolous claims and file frivolous lawsuits and make a lot of money without doing any work. It’s a blessing that the constitution allows personal injury attorneys to be paid on a contingency basis; without that type of system, there would be no way an injured person could afford to hire a personal injury trial lawyer to litigate their case.
What happens is, the attorney will bring forth the lawsuit and cover all expenses associated with filing the lawsuit, including hiring and paying expert witnesses, doctors and taking depositions and the like; all of those costs can run in the tens of thousands of dollars on certain cases. Under our system, the Florida Bar allows the attorney to present the case and advance those costs and only collect their money after the case has resolved. The fees are usually 33 percent if the case settles before going to court and 40 percent if it does, plus recovery of the costs that were advanced.
What Makes You Different and Particularly Suited to Handle A Personal Injury Case?
I don’t know if I’m different, but I can tell you that we are a very customer-based small firm practice; we meet with and know the names of all of our clients; you will speak to me and I will try your case. When you go to the bigger personal injury plaintiff’s firms, you’ll see someone’s name on the name of the firm, but you’ll likely never meet them and they will know nothing about your case, but that’s not what we do here. We do one case at a time and if we believe that you were wrongly injured and you have substantial damages as a result, we will do everything we can and spare no expense to bring your case to trial and get you justice.
That’s what makes us at least somewhat different than a lot of these bigger firms; we’re kind of like a boutique firm, in that we take pride in not having a ton of clients, just good clients who all know who we are. We’ve been doing this in Miami for over 27 years; it’s a very small community of defense lawyers and judges and adjusters and we seem to have a very good working relationship and helping our clients get the most they can for their losses.
